Council on Environmental Quality (CEQ) 2020 Rule Procedure Updates Deadline Extended

On July 16, 2020, the CEQ issued a final rule revising the implementing regulations of the National Environmental Policy Act (NEPA); commonly referred to as the ‘2020 Rule’. This rule required federal agencies to recommend revisions to their own NEPA procedures to stay consistent with the 2020 Rule by September 14, 2021. Through this interim final rule, CEQ is revising 40 CFR 1507.3(b) to extend the deadline from 12 months to 36 months, providing federal agencies an additional two years. Thus, making the new deadline September 14, 2023, for proposing NEPA procedural updates.

CEQ invites comments on the 40 CFR 1507.3(b) amendment regarding the two-year extension, and CEQ’s intention for issuing this amendment as an interim final rule.

  • CEQ request for comments deadline is July 29, 2021
