The client’s attorneys retained NV5 building scientists as expert witnesses in a case where the duration of loss of marble floors was crucial to the legal outcome. NV5 assisted defense attorneys throughout the litigation process by going over the observations and findings of the original report, providing a comparison of the conditions in the home with the first and second site visits, reviewing depositions, providing questions for the defense imposed to the opposing expert, discussing trial tactics, and providing photos and layouts for trial exhibits.
Furthermore, NV5 was well-suited to provide expert witness services in this specific case because NV5’s research department conducted a scientific tile study on how water and temperature effects various tile flooring in 2018 and 2019 and the findings of that study were published in a peer-reviewed paper, Floor Tile Movement: The Effects of Temperature and Liquid Water Exposure. One of the authors of the study worked closely with the defense throughout the litigation process.
